OUR POLICY 

POLICY STATEMENT:  We aim to please our customers in providing some of the highest quality art work from one of today’s most outstanding artist.  Please consider that while we attempt to provide you with the highest definition photographs possible, sometimes they may fall short of this quality for various photographic reasons.  If you have any questions about the quality of any image or frame viewed on this website you should always request that additional photos and information be sent to you before making your purchase.  When possible, arrangements should be made to visit the Artist’s studio to view the actual art work.  The following conditions are intended to help us to better serve you.

 

GIFT CERTIFICATES and COMMISSIONED WORK:  Please contact Mr. Spearman direct at "spearmanart@gmail.com" for specific information and requests.  
 

  1. PAYMENT – We have two means of purchasing and making payments on your selected art work.

    1. FULL PAYMENT:  You may pay for your purchase in full when using the Cart Button for each image. These payment transactions will be processed directly through PayPal.   

      1. Credit Cards:  All credit cards must be processed through PayPal.

      2. Checks and Money Orders:  Can be mailed directly to the seller.  You will receive a receipt for your payment after it has cleared the bank.  Your artwork will be mailed to you only after we have received payment in full.

  2. LAYAWAY PLAN:  For those who would prefer spreading the payment out over a period of time.

    1. You should contact (James Spearman), through his email address: spearmanart@gmail.com.

    2. We will discuss the best plan suited for your needs.  We will discuss a deposit amount and monthly payments.  There will be no interest charge.

      1. Purchases of $100 to $600 can be paid in 3 months.

      2. Purchases of $601 to $1200 can be paid in 6 months.

      3. Purchases of $1201 and higher must be paid in 12 months.

        1. There will be a non-refundable 50% deposit required on all GiClee prints.

        2. All layaway items must be paid in full in 3, 6, or 12 months as indicated in #4.  Special consideration may be given for some higher priced items.  

        3. Payments may be made:

          1. By Credit Card through PayPal - Invoiced by Paypal..

          2. Or by Check -  Invoiced by James Spearman .

      4. We will keep the artwork in safe storage until the final payment is made.  At that time the artwork will be shipped to you or arrangements will be made for you to pick CANCELLING ORDERS:

        1. Originals and Regular Prints:   Orders can be canceled within 24 hours after order is placed without penalty.  If item has been shipped see (no 8. Returns).

        2. GiClee Prints:  GiClee prints are printed per your order.  Cancellation must be received within 24 hours.  There will be a charge of 50% of retail price to cancel if printing process has begun

  3. NONPAYMENT AND FAILURE TO COMMUNICATE: If you cannot make a monthly payment, you must contact us as quickly as possible. If we do not receive payment, and we do not hear from you, we will make every effort to contact you to resolve the situation. But if we receive no payment or communication from you for 60 consecutive days, you will be in default, your payment plan will be terminated. The reserved artwork will go back on the market, and you will forfeit whatever payments you have already made. To repeat: When you make no payments nor communicate with us for a period of 60 days or longer, you will forfeit the artwork and all payments made.

  4. RETURNS:  You will be responsible for postage and insurance cost of all returns. Returns will be accepted as listed below or as indicated on sells slip.

    1. “Special Sell or Discount, as is”, cannot be returned.                                 

    2.  All returns must be in the original box that they were shipped in, and in the same condition as you received it.

    3. Original work:  A full refund will be given for all original artwork returned within 15 days, in the original box and no damages.

    4. Commissioned work: No returns accepted after 30 days.

    5. GiClee Collectibles:   GiClee prints are printed per your order.  A 50% of Retail price will be deducted on all returns. No returns after 15 days.

    6. Regular Prints: A 10% restocking fee will be charged.

    7. Personalized artwork:  There will be no returns on work that has been personalized.

  5. SHIPPING:  After receiving payment in full.

    1. Originals will be shipped in a minimum of 3 to 4 business days.

    2. GiClees will be shipped in a minimum of 7 to 14 business days.

    3. Regular Prints will be shipped in a minimum of 4 to 5 business days.

    4. We will be responsible for all insurance cost when shipping to you.

    5. DEMAGES:  If you receive artwork that has been damaged in shipping you must file claim with the carrier per their instructions.

  6. DAMAGES:  Damage to stretched canvas and frames can sometimes be repaired.  Photos must be submitted to the artist.  The Artist will determine the extent of the repair and cost involved.
